What is a GDPR chatbot?
A GDPR chatbot is a chatbot whose processing of personal data complies with the European regulation, from collection to deletion.
In practice, that means the provider can answer simple questions: what data is collected, where it is hosted, how long it is kept, who can see it and how a visitor can ask for it to be deleted.
A chatbot that answers your customers without being able to answer these questions is not a GDPR chatbot, even if it works well.
What data does a chatbot really collect?
A chatbot can collect the content of messages, the IP address, technical browsing data, and sometimes a name or an email if the visitor enters them.
Every element counts. A visitor who writes "I'm looking for a room for two people from the 14th to the 16th" does not give the same information as a visitor who writes "my order number is 4821, can you correct my delivery address?".
The good practice is to collect the minimum needed for the answer. If your chatbot asks for an email to send a quote, that is justified. If it asks for a phone number to answer a question about opening hours, it is not.
Where are the conversations hosted?
Hosting is the point most closely watched by data protection authorities in Europe.
If your chatbot stores conversations on servers located outside the European Union, a data transfer takes place. This transfer is possible, but it requires a solid legal framework: standard contractual clauses, risk analysis, information for the individuals concerned.
Hosting in the EU simplifies this step. The data stays in the same legal space as your customers, and you do not have to document a transfer to a third country.
It is an easy criterion to check: ask where the servers are, and ask in writing.
Does the provider use your conversations to train its model?
This is the question few businesses ask, and it is often the one that matters most.
A chatbot can work in two ways. Either it relies on a general-purpose model that learns from all the conversations it processes. Or it relies only on your content - your pages, your documents, your policies - and does not use the exchanges with your visitors to train.
In the second case, your customers' data is used only to answer your customers. It is simpler to explain in your processing register, and more reassuring for your users.
So ask explicitly: "Are my visitors' conversations used to train your model or to improve your product?" The answer must be clear, not evasive.
What obligations do you have, as a business?
You remain responsible for processing your visitors' data, even if a provider operates the chatbot for you.
This involves a few concrete actions:
- Mention the chatbot in your privacy policy.
- State the purpose: answering questions, qualifying a request, passing it to a human.
- Specify the retention period for conversations.
- Sign a data processing agreement with the provider (Article 28 of the GDPR).
- Plan how a visitor can request access to their data or its deletion.
None of this is specific to chatbots. It is the same work as for a contact form or an emailing tool - but it has to be done.
Is a chatbot that cites its sources more compliant?
A chatbot that cites its sources is easier to audit, because you can check where each answer comes from.
When an agent answers from your own pages and documents, the answer is traceable. You know which information was used, and you can correct the source if it is outdated. This also reduces the risk of an agent inventing information - for example a refund promise that does not exist in your terms.
For compliance, the effect is indirect but real: fewer invented answers, fewer unkept commitments, fewer complaints.
What happens when a human takes over the conversation?
The handover to a human should stay in the same thread, with the full history attached.
This is a matter of compliance as much as quality. If the visitor has already given their name, their order number or a medical detail, your team does not have to ask for it again. The context follows the conversation.
A chatbot that escalates cleanly also avoids the multiplication of data copies in separate mailboxes. One conversation, one place.
How to check a provider in five questions
Here are the questions to ask before signing, and what a good answer contains.
- Where is the data hosted?: Expected answer: In the European Union, with the precise location
- Are conversations used to train the model?: Expected answer: No, or only with explicit consent
- Is the data encrypted?: Expected answer: Encryption in transit, for example TLS
- Is the data resold or shared?: Expected answer: No
- Is a data processing agreement provided?: Expected answer: Yes, signed before going live
If a provider hesitates on any of these lines, dig deeper. Hesitation about hosting or about model training is a signal.
